1. Agreement to These Terms
These Terms of Service govern your access to SmiteSource, including our website, mobile app, community features, and connected services. By accessing or using SmiteSource, you agree to these Terms. If you do not agree, do not use the service.
Our Privacy Policy explains how we collect, use, and protect personal information. It is a separate document and should be read together with these Terms.
2. Who May Use SmiteSource
You must be at least 13 years old and legally permitted to use SmiteSource where you live. If you are not old enough to agree to these Terms on your own, a parent or legal guardian must agree on your behalf and is responsible for your use of the service.
3. Accounts and Connections
Some features require a SmiteSource account. You agree to provide accurate information, keep access to your sign-in method secure, and notify us if you believe your account has been compromised. You are responsible for activity performed through your account.
You may choose to connect third-party accounts, such as Google, Twitch, Discord, Steam, Epic Games, or Xbox. You may only connect accounts that you own or are authorized to use. Connected services may apply their own terms and policies.
4. Community Content
You keep ownership of builds, tier lists, profile details, and other content you submit to SmiteSource. You are responsible for your content and must have the rights needed to publish it.
When you publish content, you grant SmiteSource a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, distribute, and technically adapt that content as needed to operate, improve, and promote the service. This license ends when the content is deleted, except for reasonable backups, content you choose to retain after account deletion, and copies we must keep for legal or security reasons.
5. Acceptable Use
You agree not to use SmiteSource to:
- Break the law or encourage illegal activity.
- Harass, threaten, impersonate, exploit, or deceive another person.
- Post content that infringes intellectual property, privacy, or other rights.
- Distribute spam, malware, harmful code, or misleading links.
- Access nonpublic systems, evade access controls or rate limits, or interfere with the operation or security of the service.
- Use automated tools in a way that overloads, damages, or materially disrupts SmiteSource or other users.
6. SmiteSource Content
Except for community content and third-party materials, SmiteSource owns or licenses the service, including its original design, software, text, and branding. You may use the service for personal, lawful purposes. You may not copy, sell, sublicense, or commercially exploit our original content without permission.
7. Game Data and Third-Party Services
SmiteSource uses game data and may link to or integrate with third-party services. Those services control their own availability, data, and terms. We are not responsible for their content, actions, outages, or changes.
SmiteSource is an independent community service and is not affiliated with or endorsed by Hi-Rez Studios. SMITE, Hi-Rez, and related names, game data, artwork, and trademarks belong to their respective owners.
8. Paid Features
If SmiteSource offers paid features, the price, included benefits, billing period, and renewal terms will be shown before purchase. Payments made through an app store or another payment provider are also governed by that provider's terms. You can manage or cancel a recurring purchase through the platform where you bought it. Refunds are handled under the provider's rules and applicable law.
9. Moderation and Account Access
We may review, limit the visibility of, or remove content that violates these Terms or creates risk for users or the service. We may warn, restrict, suspend, or terminate an account for the same reasons, for repeated abuse, or when required by law.
You may stop using SmiteSource at any time. Account deletion is available through our verified deletion flow. Some provisions of these Terms, including ownership, disclaimers, and liability limits, continue to apply after access ends.
10. Service Availability
We may add, change, suspend, or discontinue features. We try to keep SmiteSource accurate and available, but maintenance, technical issues, third-party changes, and game updates may cause delays, errors, or interruptions. We do not guarantee that any feature or community content will always remain available.
11. Disclaimers
SmiteSource is provided on an "as is" and "as available" basis to the fullest extent permitted by law. Game statistics, match records, builds, tier lists, recommendations, and other content may be incomplete, delayed, or inaccurate. They are provided for informational and entertainment purposes and do not guarantee any in-game result.
12. Limitation of Liability
To the fullest extent permitted by law, SmiteSource and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, revenue, or opportunities arising from your use of the service. Our total liability for claims relating to the service will not exceed the greater of US$100 or the amount you paid to SmiteSource in the 12 months before the event giving rise to the claim.
Some jurisdictions do not allow certain exclusions or limits, so these limits apply only to the extent allowed by applicable law.
13. Changes to These Terms
We may update these Terms to reflect changes to SmiteSource or legal requirements. We will post the updated Terms here and change the effective date. If a change materially affects your rights, we will provide reasonable notice when appropriate. Continuing to use SmiteSource after the updated Terms take effect means you agree to them.
